1. Who we are

Flobility LLC (“Flobility”, “we”, “us”) operates flobilityos.com and the FlobilityOS application. We are the controller of the personal information described here.

2. Information we collect

2.1 You give us

Application information — Name, email, location, and your written answers about your physical history, what you have tried, your goals, your available time, and any restrictions a practitioner has given you.

Account information — Name, email, password (stored hashed, never in readable form).

Images and video — Photographs and short video of yourself in specified positions, submitted by you for postural reading.

Optional assessment answers — If you choose to complete an optional questionnaire and consent to its use, your answers. This is optional and the Service works without it.

Communications — Messages you send us, including conversations with any automated assistant in the Service.

2.2 Collected automatically

Device and browser type, operating system, IP address, general location derived from IP, pages and screens viewed, session times, and how you interact with features. Approximate rather than precise location.

2.3 From others

Transaction confirmations, subscription status, and partial payment details (such as card type and last four digits) from our payment processor. We never receive or store your full card number.

3. Sensitive information

Some of what we collect is sensitive, and we treat it accordingly.

Health-related information. Your application answers may describe injuries, pain, diagnoses, or restrictions. We collect this only because you provide it, and only to decide whether the Service is appropriate for you and to make it safe for you to use. We do not sell it, use it for advertising, or share it for anyone else’s purposes.

Images of your body. See Section 4.

Optional assessment answers. Used only if you give separate consent, only to adjust how the Service communicates with you, and never for advertising. You can withdraw consent at any time.

4. Images and video — what happens to them

We use images only to produce a reading about body position.

Images are processed by automated software, and where appropriate reviewed by us, in order to determine whether a position meets a defined standard.

We do not perform facial recognition. We do not extract, derive, or store face geometry, iris scans, fingerprints, voiceprints, or hand or retina geometry. We do not use images to identify or verify who you are. We do not use them for advertising, do not sell them, and do not publish them or use them in marketing without your separate written permission.

Images may be processed by third-party artificial intelligence providers acting on our instructions. We do not permit those providers to use your images to train their own models.

Retention. Images are retained for 12 months to allow comparison over time, then deleted. You may request deletion of any or all images at any time by emailing contact@flobility.com, and we will delete them within 30 days.

5. How we use information

  • To evaluate applications and decide whether to grant access

  • To create and administer your account

  • To provide the Service, including producing readings from images you submit

  • To personalize how the Service communicates with you, where you have consented

  • To process payments and manage subscriptions

  • To respond to your messages and provide support

  • To keep the Service secure and detect misuse or fraud

  • To improve the Service, using aggregated or de-identified information wherever possible

  • To comply with legal obligations

We do not use your information for behavioral advertising, and we do not sell it.

6. Automated processing

Readings about body position are produced in part by automated systems, and this affects what content is available to you within the Service.

These readings are educational outputs about movement, not medical decisions, and produce no legal effect. If you believe a reading is wrong, you may resubmit or contact contact@flobility.com and a person will review it.

7. Who we share with

We share personal information only with service providers acting on our instructions, and only as needed:

Payment processing — Name, email, billing information

Hosting and storage — All Service data, encrypted in transit and at rest

Artificial intelligence and machine learning providers — Images, and message content, for processing only

Email and communications — Name and email

Analytics — Usage and device information

We may also disclose information where required by law, in response to valid legal process, to protect rights or safety, or in connection with a merger, acquisition, or sale of assets — in which case we will notify you.

We do not sell personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under U.S. state privacy laws.

8. Retention

Application information (declined) — 12 months, then deleted

Account information — For as long as your account is active, then 12 months

Images and video — 12 months from submission

Assessment answers — Until you withdraw consent or close your account

Payment records — As required by tax and accounting law, typically 7 years

Support messages — 12 months

9. Security

We use encryption in transit and at rest, access controls, hashed passwords, and limited internal access on a need-to-know basis. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

If a breach affects your personal information we will notify you as required by law.

10. Your rights

Depending on where you live, you may have the right to:

  • Know what personal information we hold and how we use it

  • Access a copy of it

  • Correct inaccurate information

  • Delete your information

  • Portability — receive it in a portable format

  • Withdraw consent where processing is based on consent

  • Opt out of sale or targeted advertising (we do neither)

  • Non-discrimination for exercising any of these rights

To exercise any right, email contact@flobility.com. We will respond within 45 days and may need to verify your identity first. You may use an authorized agent.

Appeals. If we decline a request, you may appeal by replying to our response. We will respond to an appeal within 45 days.

10.1 Deleting your account

You can delete your account and associated personal information at any time from within the app, or by emailing contact@flobility.com. We will complete deletion within 30 days, except for records we are legally required to keep.

11. Children

The Service is for adults. We do not knowingly collect information from anyone under 18. If you believe a minor has provided us information, contact contact@flobility.com and we will delete it.

12. Where information is processed

We operate in the United States and your information is processed there. If you access the Service from elsewhere, you understand your information will be transferred to and processed in the United States.

13. Cookies

We use cookies and similar technologies to keep you signed in, remember preferences, and understand usage. Essential cookies are required for the Service to work. You can control non-essential cookies through your browser settings.

14. Changes

We may update this policy. Material changes will be notified by email or in the Service before they take effect. The “Last updated” date always reflects the current version.
