1. Who these terms are between
These Terms of Use (“Terms”) are a binding agreement between you and Flobility LLC, a limited liability company (“Flobility”, “we”, “us”).
They govern your use of flobilityos.com, the FlobilityOS application, and any related services (together, the “Service”).
By submitting an application, creating an account, or using any part of the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. The Service is not directed at, and may not be used by, anyone under 18. We do not knowingly collect information from anyone under 18. If we learn that a user is under 18, we will terminate the account and delete the associated data.
Access is currently offered only to residents of the United States. You may not use the Service from any jurisdiction where doing so would violate local law.
3. Access is by application and is discretionary
The Service is not sold openly. Access is granted by application and at our sole discretion.
We may decline any application for any lawful reason or for no reason, and we are not obliged to explain a decision. Submitting an application does not create an account, a contract, or any expectation of access.
We may also suspend or revoke access at any time if we believe, in our reasonable judgment, that continued access is unsafe for you, unsafe for others, or inconsistent with these Terms.
4. What the Service is, and what it is not
FlobilityOS is a movement education and physical training service. It provides instructional material, structured practice sequences, breathing exercises, and software that produces categorical readings from images you choose to submit.
The Service is not medical care. We are not physicians, physical therapists, chiropractors, psychologists, or licensed healthcare providers of any kind, and we do not act as such.
Nothing in the Service is:
a medical diagnosis, opinion, or assessment
a treatment, cure, or therapy for any condition
physical therapy, rehabilitation, or clinical care
mental health care, counseling, or psychological treatment
a substitute for professional medical advice
Any output of the Service, including any classification, band, reading, result, or message from an automated assistant, is educational information about movement only. It is not a clinical finding and must not be relied on as one.
Always consult a qualified healthcare provider before beginning this or any physical training program, and particularly if you have any injury, illness, disability, are pregnant, or are under the care of a practitioner.
5. Assumption of risk
Physical training carries inherent risk of injury, including serious injury and death. You accept that risk knowingly and voluntarily.
By using the Service you acknowledge that:
you are voluntarily participating in physical activity
you are solely responsible for deciding whether any movement is appropriate for your body on a given day
we cannot observe you, correct you in person, or intervene if something goes wrong
you will stop immediately if you experience pain, dizziness, shortness of breath, chest discomfort, faintness, or any symptom that concerns you, and seek medical attention if warranted
you will not attempt any movement you have been advised against by a healthcare provider
You are responsible for your training environment: adequate space, stable surfaces, and the absence of hazards.
5.1 Breathing exercises — specific warning
The Service includes breathing and breath-control exercises. These carry risks distinct from other movement, including lightheadedness, dizziness, tingling, fainting, and loss of consciousness.
You agree that you will:
perform all breathing exercises seated or lying down on a stable surface
never perform them in or near water, while driving or operating machinery, while standing on a hard surface, at height, or anywhere a fall could cause injury
stop immediately at any sign of dizziness or lightheadedness
Do not use breathing exercises without first consulting a physician if you have or have had any cardiovascular condition, respiratory condition including asthma, seizure disorder or epilepsy, aneurysm, high or low blood pressure, glaucoma or retinal detachment, panic disorder, or if you are pregnant.
6. Images and video you submit
Parts of the Service ask you to submit photographs or short video of yourself in specified positions.
6.1 What we do with them
Images are processed by automated software and, where appropriate, reviewed by us, in order to produce a categorical reading about body position — for example whether a position meets a defined standard, does not meet it, or cannot be determined from the image supplied.
6.2 What we do not do with them
We do not:
use facial recognition or attempt to identify you from an image
extract, derive, store or use any face geometry, iris scan, fingerprint, voiceprint, or hand or retina geometry
use your images to identify or verify identity for any purpose
sell your images, or disclose them to third parties for their own purposes
publish your images, or use them in marketing or as examples, without your separate written permission
6.3 Your responsibilities
You must only submit images of yourself. You must not submit images of any other person. You must not submit any image of a minor. You must not submit images containing nudity or sexual content.
You retain ownership of your images. You grant us a limited license to process, store, and analyze them solely to provide the Service to you.
6.4 Automated processing
Readings are produced in part by automated systems, including systems operated by third-party providers. Automated readings can be wrong. A reading is a categorical output based on a single image and does not account for pain, injury, medical history, or anything the image does not show. Do not treat a reading as a clinical assessment. You remain solely responsible for what you do with any reading.
7. Our intellectual property
The Service, and everything in it, is our property or that of our licensors. This includes but is not limited to: the methodology, frameworks, terminology, classification systems, assessment logic, program structure, written material, audio, video, images, software, and the content, behaviour and outputs of any automated assistant within the Service.
Substantial parts of the Service constitute confidential information and trade secrets.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the Service for your own personal, non-commercial use.
You may not:
copy, reproduce, republish, distribute, or publicly display any part of the Service
record, screenshot, screen-capture, download, or otherwise capture Service content, except where a download function is expressly provided
share your login credentials, or allow any other person to access the Service through your account
use the Service, its content, or any of its outputs to teach, coach, train, advise, or provide services to any other person, whether paid or unpaid
use the Service or its outputs to develop, train, fine-tune, evaluate, or improve any machine learning model, dataset, or competing product
reverse engineer, decompile, or attempt to derive the underlying logic, models, rules, or thresholds of any part of the Service
scrape, crawl, or use any automated means to access or extract from the Service
remove or obscure any proprietary notice
These restrictions survive termination of your access.
8. Your account
You are responsible for keeping your credentials confidential and for all activity under your account. Accounts are personal and may not be shared, transferred, or sold. Notify us immediately at contact@flobility.com if you believe your account has been accessed without authorisation.
We may limit concurrent sessions or devices and may terminate accounts we reasonably believe are being shared.
9. Fees and billing
9.1 Payment processing
Payments are handled by a third-party payment processor on our behalf. We do not receive or store your full card number. Your purchase may also be subject to the payment processor’s own terms and privacy policy, which are presented to you at checkout.
A processor or company name other than Flobility may appear on your bank or card statement.
9.2 Subscription terms
The Service is offered on a recurring subscription basis.
The current price and billing interval are disclosed to you before you purchase and again at checkout.
Your subscription renews automatically at the end of each billing period at the then-current price, and your payment method is charged, until you cancel.
Applicable taxes may be added.
We may change pricing for future billing periods on at least 30 days’ notice. Continued use after the change takes effect constitutes acceptance. If you do not accept, cancel before the change takes effect.
9.3 Cancellation
You may cancel at any time from your account settings, or by emailing contact@flobility.com.
Cancellation stops future billing. It takes effect at the end of your current paid period, and you retain access until then. Cancelling does not refund amounts already paid, except as set out in the Refund Policy below or as required by law.
9.4 Failed payments
If a payment fails, we may retry, suspend access, and ultimately terminate the subscription. You remain responsible for amounts properly owed.
9.5 Chargebacks
If you have a billing concern, contact us first at contact@flobility.com. We aim to resolve billing issues quickly and directly.
Initiating a chargeback without first contacting us may result in immediate and permanent termination of access. We reserve the right to dispute chargebacks we believe are unfounded, and to recover associated fees where permitted by law.
10. Refund policy
All payments are final and non-refundable. You may cancel at any time to prevent future billing, and you retain access to the end of the paid period. We may issue discretionary refunds in exceptional circumstances.
Nothing in this policy limits rights you have under applicable consumer protection law.
11. Third-party services
The Service relies on third parties including payment processing, hosting, storage, analytics, and providers of artificial intelligence and machine learning services. We are not responsible for third-party services, and your use of them may be subject to their own terms.
12. Termination
You may stop using the Service at any time and cancel as described above.
We may suspend or terminate your access immediately and without refund if you breach these Terms, if we believe your conduct creates risk to yourself or others, or if we discontinue the Service.
On termination, your license ends immediately and Sections 4, 5, 6, 7, 9.5, 13, 14, 15 and 16 survive.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY AUTOMATED READING OR OUTPUT WILL BE ACCURATE OR COMPLETE.
WE MAKE NO REPRESENTATION OR GUARANTEE OF ANY PARTICULAR RESULT. Outcomes depend on factors outside our control. Nothing in the Service is a promise that any condition will improve, that pain will reduce, or that any physical change will occur.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Flobility, its officers, members, employees and agents from any claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, your violation of any law, or your violation of any third party’s rights — including any claim arising from images you submit.
16. Disputes, governing law, and arbitration
These Terms are governed by the laws of the State of Utah, without regard to conflict of laws principles.
Informal resolution first. Before starting any formal proceeding, you agree to contact us at contact@flobility.com and attempt in good faith to resolve the dispute for at least 30 days.
Binding arbitration. Any dispute not resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its rules, before a single arbitrator, seated in Summit County, Utah. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver. You and Flobility each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.
Small claims exception. Either party may bring an individual claim in small claims court.
Opt-out. You may opt out of arbitration and the class waiver by emailing contact@flobility.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms.
17. Changes to these Terms
We may update these Terms. If a change is material we will give reasonable advance notice by email or in the Service. Continued use after the effective date constitutes acceptance. The “Last updated” date above always reflects the current version.
18. General
These Terms are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
